Terms of Service
These terms govern your use of Second Chapter Book Swap (the “Service”) operated by Nadia Egli, 8808 Pfäffikon, Switzerland. By creating an account or using the Service you agree to these terms.
1. Who can use the Service
You must be at least 16 years old to create an account. By signing up you confirm that the information you provide is accurate and that you are using the Service for personal, non-commercial purposes (unless otherwise agreed in writing).
2. Your account
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately at privacy@secondchapterbookswap.com if you believe your account has been accessed without your permission.
3. How book swaps work
Second Chapter Book Swap is a peer-to-peer platform. We help readers find each other and exchange books, but the actual swap, including shipping arrangements, postage costs and the condition of the books exchanged, is between you and the other reader. We are not party to any swap and accept no responsibility for the conduct of users, the condition of the books exchanged, or any disputes that arise.
4. Acceptable use
You agree not to:
- Use the Service to sell, resell or distribute books commercially
- Post illegal, threatening, defamatory, hateful or sexually explicit content
- Harass, impersonate or invade the privacy of other users
- Upload content that infringes the intellectual property rights of others
- Send spam, scrape data, or use automated tools to access the Service
- Attempt to bypass security or interfere with the Service’s normal operation
We may suspend or terminate accounts that breach these rules, with or without notice.
5. Your content
You keep ownership of everything you post — book listings, personal notes, community posts, messages, photos. By posting it on the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute that content for the sole purpose of running the Service. This licence ends when you delete the content or your account, except for messages already sent to other users (which remain in their inbox).
Book covers obtained through the search feature are sourced from public APIs (Google Books, Open Library) and remain the property of their respective rights holders.
6. Membership and payments
Some features may require a paid membership. When paid memberships are active:
- Payments are processed by Stripe Inc. We do not store your card details.
- Memberships renew automatically unless cancelled before the renewal date.
- You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; we do not refund partial periods unless required by law.
If you are a consumer in the EU or Switzerland you may have a statutory right of withdrawal within 14 days of purchase. Once you start using premium features the right of withdrawal may end early, in line with applicable consumer protection law.
7. Closing your account
You can close your account at any time from your account settings, or by emailing privacy@secondchapterbookswap.com. We may close or suspend your account if you breach these terms, if your account is inactive for an extended period, or if we discontinue the Service.
8. Disclaimer
The Service is provided “as is” and “as available”. We make no warranties, express or implied, about the availability, reliability, accuracy or suitability of the Service for any particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, Nadia Egli is not liable for indirect, incidental, consequential, special or punitive damages arising from your use of the Service, the conduct of other users, or any swap that takes place via the Service. Our total liability in any twelve-month period is limited to the amount you paid us during that period (which is zero for free accounts). Nothing in these terms limits liability that cannot be limited under mandatory Swiss law.
10. Changes to the Service or these terms
We may change the Service or update these terms from time to time. Material changes will be announced on the site or by email and will take effect 30 days later. Continued use of the Service after that date constitutes acceptance of the updated terms.
11. Governing law and jurisdiction
These terms are governed by Swiss law, without regard to its conflict-of-law rules. The exclusive place of jurisdiction is the registered domicile of the operator in Switzerland, subject to any mandatory consumer protection rules that grant you the right to bring proceedings in your country of residence.
